Ruling of Umrah, its Evidence, and the Mawaqeet of Hajj and Umrah

The fifth Issue: Ruling of Umrah, and its evidence

It is obligatory to do 'Umrah on the one who is able to do it once in a lifetime, because Allah says:

{وَأَتِمُّوا الْحَجَّ وَالْعُمْرَةَ لِلَّهِ}.

{And complete the Hajj and 'umrah for Allah}. (Al-Bakorah:196).

And for the saying of the prophet{peace be upon him) to A'aisha(may Allah be pleased with her) when she asked him:

[هل على النساء جهاد؟ قال: "نعم عليهن جهاد لا قتال فيه: الحج والعمرة"].

[Is Jihad obligatory for women?’ He said: “Yes: Upon them is a Jihad in which there is no fighting: Al-Hajj and Al-‘Umrah]. (Recorded by Ahmad,6/165, and Ibn Majah, No:2901).

And his saying to Abu RAzin when he asked that:

[أن أباه لا يستطيع الحج، ولا العمرة، ولا الظعن. قال: "حج عن أبيك واعتمر"].

[His father is an old man who cannot perform Hajj or 'Umrah, nor can he travel." He said "Perform Hajj and 'Umrah on behalf of your father]. (Recorded by Abu Dawood, No:1810, and An-Nasaai,5/111).

It has three pillars, namely; Ihraam(It is the intention of starting the Hajj acts of worship), Tawwaf, and Sa'y(between the Safa and Marwa).

The sixth Issue: Mawaqeet of Hajj and Umrah.

Meeqat in Arabic language: is the limit. In Shariah: It is the place of worship or its time. Mawaaqeet are divided into: Time and Site.

As for Mawaqeets' times for Hajj and Umrah.

It is permitted to perform Umrah at all times of the year.

As for the Hajj, it has certain months that any act of Hajj is not valid except in it, because Allah says:

{الْحَجُّ أَشْهُرٌ مَّعْلُومَاتٌ}.

{Hajj is [during] well-known months...}. [Al-Baqarah: 197]. It is Shawwal, Dhu'l-Qa'dah and Dhu'l-Hijjah.

As For The Fixed Sites For Entering The State Of Ihraam for Hajj and 'Umrah: They are the limit sites that the one in Hajj and Umrah should not exceed except with ihraam.

The Messenger of Allah (peace and blessings of Allah be upon him) in the hadeeth of Ibn 'Abbaas (may Allaah be pleased with him and his father) who said:

[وقت رسول الله صلى الله عليه وسلم - لأهل المدينة ذا الحليفة، ولأهل الشام الجحفة، ولأهل نجد قرن المنازل، ولأهل اليمن يلملم، هن لهن، ولمن أتى عليهن من غير أهلهن ممن أراد الحج والعمرة، ومن كان دون ذلك فمن حيث أنشأ، حتى أهل مكة من مكة].

[Allah's Messenger(peace and blessings of Allah be upon him) made Dhul-Huiaifa as the Miqat for the people of Medina; Al-Juhfa for the people of Sham; Qarn-al-Manazil for the people of Najd; and Yalamlam for the people of Yemen; and these Mawaqit are for the people at those very places, and besides them for those who come thorough those places with the intention of performing Hajj and `Umra; and whoever is living without these boundaries can assume lhram from the place he starts, and the people of Mecca can assume Ihram from Mecca]. (Recorded by Al-Bukhaari, No:1524, and Muslim, No:1181).

Whoever exceeds these Mawaqeet without Ihraam, it is compulsory on him to return to them. But if he cannot return, then it is obligatory on him to pay ransom, which is a sheep that he will slaughter in Makkah, and distribute it to the poor of the Haram.

As for those who is living without these boundaries, they should assume Ihram from their places, because the Prophet (peace and blessings of Allah be upon him) said in the previous hadith:

[Whoever is living without these boundaries can assume lhram from the place he starts, and the people of Mecca can assume Ihram from Mecca].
