Summary of the verdict of the council of senior scholars’ –kingdom of Saudi Arabia.

Islam enjoined truthfulness in speech, justice in dealings, fulfilling of promises and agreements and commitment to pledges and treaties.

The Qur’an and the Sunnah came to enforce the fulfillment of commitments and pledges, and the discharge of trusts. They prohibit betrayal, breach of agreements, treachery and vehemently oppose whoever does that. They made faithfulness to trusts and pledges as part of the qualities of the believers, Allah says:

وَٱلَّذِينَ هُمْ لِأَمَٰنَٰتِهِمْ وَعَهْدِهِمْ رَٰعُونَ

{ Those who are faithful to their trusts and pledges } [ The Believers: 8).  

Allah enjoined His Messenger  (may the peace and blessings of Allah be upon him) to be committed to his pledges in relation with Muslims and non-Muslims, Allah says:

وَلَا تَقْرَبُوا۟ مَالَ ٱلْيَتِيمِ إِلَّا بِٱلَّتِى هِىَ أَحْسَنُ حَتَّىٰ يَبْلُغَ أَشُدَّهُۥ ۚ وَأَوْفُوا۟ بِٱلْعَهْدِ ۖ إِنَّ ٱلْعَهْدَ كَانَ مَسْـُٔولًا

{ And do not go near the orphan's property, except with the best of intentions, until he has reached his maturity. And honor your pledge, because the pledge involves responsibility.}[Al-Israa: 34)

When the Prophet (may the peace and blessings of Allah be upon him) migrated to Al-Madina, he ordered Ali (may Allah be please with him) to return to Quraish their belongings that were deposited with him. on the authority of Ali(may Allah be please with him) that “ when the Prophet(may the peace and blessings of Allah be upon him) left to Madina during the migration, he ordered me to stay behind until I return to people their belongings that were deposited with him”

It is compulsory for a Muslim to be committed to the rules of the sharia even if he is in the land of the non-Muslims. From among such rules is that, it is not allowed to transgress upon the lives of non-Muslims or their honor and wealth as was purported by many texts from the Qur’an and the Sunnah.

The Messenger of Allah (may Allah’s peace and blessings be upon him) was keen on preserving the agreements between him and the unbelievers of Quraish in the treaty of Hudaibiya until the treaty was breached by the Quraish. In a narration concerning the Hudaibiya (treaty) a sahaaba known as Al-Mughira Ibn Shu’ba accompanied a people in the jahiliyya on a journey, he killed them and took away their properties and then came and embrace islam upon which the Prophet (may the peace and blessings of Allah be upon him ) said: “ as for your islam we accepted it but for the properties , they are obtained from betrayal and we don’t have need of it”

The Messenger of Allah (may the peace and blessings of Allah be upon him) remained in Makkah for 13 years along with the Muslims but he never permitted anyone of them to loot anyone’s wealth, to spill any blood or to defile anyone’s honor. He then migrated to Madina leaving some Muslims back in Makka who remained there as the minority and weak group, but he never permitted anyone of them to do anything of that sort.

These texts addressed the Muslim and serve as evidences for him in any condition that he found himself and everywhere he resides, whether his dealings with his fellow Muslim or non-Muslim, for Allah enjoined justice in interpersonal dealings even with non-muslims. Allah says:

يَٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوا۟ كُونُوا۟ قَوَّٰمِينَ لِلَّهِ شُهَدَآءَ بِٱلْقِسْطِ ۖ وَلَا يَجْرِمَنَّكُمْ شَنَـَٔانُ قَوْمٍ عَلَىٰٓ أَلَّا تَعْدِلُوا۟ ۚ ٱعْدِلُوا۟ هُوَ أَقْرَبُ لِلتَّقْوَىٰ ۖ وَٱتَّقُوا۟ ٱللَّهَ ۚ إِنَّ ٱللَّهَ خَبِيرٌۢ بِمَا تَعْمَلُونَ

{  O you who believe! Be upright to God, witnessing with justice; and let not the hatred of a certain people prevent you from acting justly. Adhere to justice, for that is nearer to piety; and fear God. God is informed of what you do.} (Al-Maa’ida: 8)

·        It is not allowed for one who entered the land of non-Muslims to betray them. This includes even those who are the original citizens of that land and those who embrace Islam there. He must not betray them nor cause corruption in their land either with regards to their lives, honor, wealth and others.

·        It is impermissible for a Muslim to spread any kind of immorality in the land of the non-Muslims such as drugs.

·        It is compulsory on a Muslim to keep himself away from all such breach of rules and to abstain from them as this affect the image of Islam and Muslims.
