The Sacrificial Animal and its Rulings.

The third Issue: The Sacrificial Animal and its Rulings.

The Sacrificial Animal: Is the Animal – camel, cow and sheep - presented to the Holy House as a sacrifice to Allah the Most High.

The types of Sacrificial Animal:

1\ The Animal sacrificed for Tamattu'u and Qiran:

This type is obligatory on the non-Makkan people, it is a sacrifice of worship not a penalty(Expiation). Based on the sayings of Allah:

{فَإِذَا أَمِنتُمْ فَمَن تَمَتَّعَ بِالْعُمْرَةِ إِلَى الْحَجِّ فَمَا اسْتَيْسَرَ مِنَ الْهَدْيِ} (البقرة: 196).

{And when you are secure, then whoever performs 'umrah [during the Hajj months] followed by Hajj [offers] what can be obtained with ease of sacrificial animals.} (Al-Baqarah: 196).

But if he can't afford the Sacrificial Animal or its price, he should fast three days during Hajj, it is permissible to fast the three days during the days of Tashreeq (i.e the 11,12 and 13 of Dhul Hijjah), and fast seven days when he returns to his people; Based on the sayings of Allah the Most High:

{فَمَن لَّمْ يَجِدْ فَصِيَامُ ثَلَاثَةِ أَيَّامٍ فِي الْحَجِّ وَسَبْعَةٍ إِذَا رَجَعْتُمْ} (البقرة: 196).

{And whoever cannot find [or afford such an animal] - then a fast of three days during Hajj and of seven when you have returned [home].} (Al-Baqarah: 196).

It is desired for the person performing to eat part of the Sacrificial Animal of Tamattu'u and Qiran. Due to the sayings of Allah:

{فَإِذَا وَجَبَتْ جُنُوبُهَا فَكُلُوا مِنْهَا وَأَطْعِمُوا الْقَانِعَ وَالْمُعْتَرَّ} (الحج: 36).

{And when they are [lifeless] on their sides, then eat from them and feed the needy and the beggar.} (Al-Hajj: 36).

2\ The Sacrificial Animal of penalty(Expiation):

This is the obligatory expiation for failing to do a compulsory act of Hajj, or committing one of the violations of Ihram, or due to prevention of completing the Hajj when its causes occur; Allah says in the Qur'an:

{فَإِنْ أُحْصِرْتُمْ فَمَا اسْتَيْسَرَ مِنَ الْهَدْيِ} (البقرة: 196).

{But if you are prevented, then [offer] what can be obtained with ease of sacrificial animals.} (Al-Baqarah: 196).

And due to the saying of Ibn Abbas (may Allah be pleased with him and his father):

"مَنْ نَسِيَ مِنْ نُسُكِهِ شَيْئًا أَوْ تَرَكَهُ فَلْيُهْرِقْ دَمًا."

" If someone forgets anything of his rituals or omits them intentionally, he must slaughter an animal." (Related by Al-Baihaqi 5/152).

It is not permissible to eat from this type of sacrifice; instead it should be given as charity to the poor people of the Haram in Makkah.

3\ Voluntary Sacrifice:

This is a desirable sacrifice for every person who goes for Hajj or Umrah; imitating the Prophet (may peace and blessings of Allah be upon him), He  made a sacrifice of 100 camels in the farewell Hajj.

And it is desired for the person performing Hajj or Umrah to eat from eat, because the Prophet (may peace and blessings of Allah be upon him):

[أَنَّ رَسُولَ اللَّهِ ـ صلى الله عليه وسلم ـ أَمَرَ مِنْ كُلِّ جَزُورٍ بِبَضْعَةٍ فَجُعِلَتْ فِي قِدْرٍ فَأَكَلُوا مِنَ اللَّحْمِ وَحَسَوْا مِنَ الْمَرَقِ.]

[ordered that a piece from every camel that had been slaughtered be brought and placed in a pot, then they ate from its meat and drank some of the broth.] (Sunan Ibn Majah Book 26, Hadith 3278).

It is also permissible for those who are not in Ihram to send their sacrifices to Makah to be slaughtered there; in order to get closer to Allah, and none of the things forbidden on the one in Ihram is forbidden on him.   

4\ The Sacrificial Animal of vow:

This is the vow made by the person performing Hajj with the aim of getting closer at the Holy House, and fulfilling this vow is compulsory; Due to the sayings of Allah:

{ثُمَّ لْيَقْضُوا تَفَثَهُمْ وَلْيُوفُوا نُذُورَهُمْ } (الحج: 29).

{Then let them end their untidiness and fulfill their vows} (Al-Hajj: 29).

And it is not permissible to eat form this type of sacrifice.
